Terms of Service
Effective October 2, 2026 · Last updated October 2, 2026
1. Who we are and what these terms cover
These Terms govern your use of the kavanah.tech website and the services offered through it: Kavanah Analytics, Kavanah Chat, Kavanah Social, Risk Management and Kavanah Hosting (the “Services”). The Services are provided by Kavanah Media, a Tennessee nonprofit corporation and Section 501(c)(3) tax-exempt organization (“Kavanah Media,” “we,” “us”), through its divisions Kavanah Tech and Kavanah Security.
Kavanah Analytics also has its own Terms of Service. Where those terms, or a written agreement between your organization and us, say something more specific, they apply to that Service. By using a Service you agree to these Terms. If you use the Services for an organization, you confirm that you are authorized to accept these Terms for it.
2. Accounts
You must be at least 18, or the age of majority where you live. Keep your sign-in details confidential; you are responsible for activity under your account. Your organization’s administrators manage who has access and what they can do. Tell us straight away at privacy@kavanahanalytics.com if you think your account has been misused.
3. Your content
“Your Content” means everything your organization puts into or connects to the Services: messages and contacts in Kavanah Chat, posts and media in Kavanah Social, assessment answers in Risk Management, files and databases in Kavanah Hosting, and the data Kavanah Analytics reads from the accounts you connect. Your organization keeps all rights in Your Content. You give us permission to host, copy, process and display it only as needed to provide, secure and support the Services for you, and as described in our Privacy Policy.
You are responsible for having the right to use Your Content and the accounts you connect, and for meeting your own obligations to the people you communicate with, including the privacy of the people who write to your team.
4. Acceptable use
You agree not to use the Services to:
- send spam, or messages or posts people have not asked for in a way the platform does not allow;
- harass, threaten, deceive or harm anyone, or to expose the identity or location of people at risk;
- host or send malware, or content that is unlawful where it is hosted or received;
- break the terms of the platforms you connect, such as the Meta Platform Terms or Google’s API policies;
- probe, scan or attack the Services or other users’ accounts, or get around their security or limits (to report a weakness, see our Security page); or
- resell the Services or share access with anyone outside your organization without our agreement.
5. Connected platforms
The Services work with platforms you choose to connect, such as Facebook, Instagram, Google, YouTube and Disciple.Tools. Your use of them is governed by their own terms. We are not responsible for their availability or behavior, and features can change or stop when those platforms change their rules.
6. Open-source software
Parts of the Services are built on open-source software: Kavanah Chat on Chatwoot and Kavanah Social on Postiz. Those components are licensed under their own open-source licenses, and nothing in these Terms limits the rights those licenses give you. Where a license requires us to make source code available, we will provide it on request. In particular, the complete source code of the version of Kavanah Social we run is available free of charge under the GNU Affero General Public License: email privacy@kavanahanalytics.com. Separately, your organization’s security team may ask to review the source code of any of our products.
7. Risk Management
Risk Management produces estimates and guidance from the information you provide, using deliberately conservative models. Its reports support your organization’s own judgment; they are not a guarantee of anyone’s safety, and they are not legal, insurance or professional security advice. Decisions about where and how your teams work, and the duty of care you owe them, remain your organization’s responsibility.
8. Kavanah Hosting
You are responsible for your website’s content, for the plugins, themes and changes you ask us to make, and for your domain registration. We may temporarily take a site offline, or restrict it, if it is compromised or is being used in a way that threatens other sites or breaks these Terms. We will tell you why and work with you to restore it.
9. Fees
Some Services carry a fee, as stated on the product page or in an agreement with your organization; mission organizations can ask about sponsored access. Unless we agree otherwise, fees already paid are not refundable. You are responsible for any taxes that apply to you.
10. Confidentiality
Each side will keep the other’s non-public information confidential, use it only for the purposes of these Terms, and protect it with at least reasonable care.
11. Our property
Apart from Your Content and the open-source components described above, the Services, including their software, design and content, belong to Kavanah Media or its licensors. “Kavanah Tech,” “Kavanah Analytics,” “Kavanah Chat,” “Kavanah Social,” “Kavanah Hosting,” “Kavanah Security” and “Kavanah Media” are names of Kavanah Media. If you send us suggestions, we may use them without obligation to you.
12. Suspension and ending
You can stop using a Service at any time and ask us to delete your data, as described in our Privacy Policy. We may suspend or end access if these Terms are broken, if use of a Service creates a security or legal risk, or if the law requires it. Where it is safe to do so, we will tell you first and give you a chance to fix the problem and to take a copy of Your Content.
13. Disclaimers
The Services are provided “as is” and “as available,” without warranties of any kind, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Services will be uninterrupted or error-free, or that information shown in them, including data from connected platforms, is complete or current.
14. Limitation of liability
To the fullest extent the law allows, Kavanah Media will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost data, revenue or goodwill, arising from the Services or these Terms. Our total liability for all claims will not exceed the greater of the fees you paid us for the Service in question in the 12 months before the claim arose, or US$100.
15. Indemnity
You will defend and indemnify Kavanah Media against claims arising from your use of the Services in breach of these Terms, from Your Content or the accounts you connect, or from your violation of the law or of anyone’s rights.
16. Governing law
These Terms are governed by the laws of the State of Tennessee, USA. Disputes will be heard in the state and federal courts in Blount County, Tennessee, except where mandatory consumer law gives you the right to bring a claim where you live.
17. Changes and general terms
We may update these Terms. We will change the date at the top and give notice of material changes, for example by email or in the product; continuing to use the Services afterwards means you accept the update. These Terms, our Privacy Policy and any written agreement between us are the whole agreement about the Services. If any part is unenforceable, the rest still applies. Neither side is responsible for delays caused by events beyond its reasonable control.
